Terms of Service

1. Acceptance of Terms
By accessing or using DocDraft ("Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
DocDraft is an AI-powered clinical document generation tool. The Service generates draft clinical documents based on user-provided input. DocDraft is a productivity tool — it does not provide medical advice, diagnosis, or treatment.
3. Professional Responsibility
All documents generated by DocDraft are drafts and must be reviewed, edited, and approved by a licensed healthcare provider before use. You are solely responsible for the accuracy, completeness, and appropriateness of any document you generate and use.
4. No Patient Data Storage
DocDraft does not store patient information, generated documents, or clinical content on our servers. Documents are generated in real-time and exist only in your browser session. Once you close or navigate away, generated content is gone.
5. Business Associate Agreement (HIPAA)
This Section 5 constitutes a Business Associate Agreement ("BAA") between Tailwind, LLC, doing business as DocDraft ("Business Associate"), and you, the healthcare provider, practice, or covered entity using the Service ("Covered Entity"), as those terms are defined under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its implementing regulations. By using the Service, Covered Entity agrees to the terms of this BAA without the need for a separate signature.
5.1 Permitted Uses and Disclosures of PHI
Business Associate may use or disclose Protected Health Information ("PHI") solely as necessary to provide the document generation services described in these Terms. Business Associate will not use or disclose PHI other than as permitted by this Agreement or as required by law.
5.2 Safeguards
Business Associate implements the following safeguards to protect PHI:
- All PHI is processed via AWS Bedrock, which is covered under a Business Associate Agreement with Amazon Web Services
- No PHI is stored, logged, cached, or persisted in any database or file system
- All data is encrypted in transit via TLS/SSL
- PHI is not used to train AI models
- DocDraft operates on a stateless architecture — documents are generated in real-time and are not retained after delivery to the user
5.3 Obligations of Business Associate
- Business Associate will report any security incident or breach of unsecured PHI to Covered Entity within 72 hours of discovery
- Business Associate will ensure that any subcontractors that handle PHI (including AWS) agree to substantially similar restrictions and conditions as contained in this BAA
- Business Associate will make its internal practices, books, and records relating to the use and disclosure of PHI available to the U.S. Department of Health and Human Services (HHS) upon request
5.4 Term and Termination
This BAA is effective upon the Covered Entity's first use of the Service and remains in effect for the duration of such use. The BAA terminates when the Covered Entity ceases all use of the Service. Upon termination, no PHI needs to be returned or destroyed because no PHI is stored by Business Associate.
5.5 Limitations
- Business Associate is not responsible for PHI after it has been displayed to, downloaded by, or otherwise made available to the user
- Covered Entity is solely responsible for the accuracy, completeness, and appropriate use of all generated documents
- The Service is a productivity tool and does not replace professional medical judgment, diagnosis, or treatment decisions
6. Accounts & Subscriptions
You are responsible for maintaining the security of your account. Subscription billing is handled through Stripe. You may cancel at any time; access continues until the end of your billing period.
7. Acceptable Use
You agree not to:
- Use the Service for fraudulent document generation
- Misrepresent AI-generated content as personally authored without review
- Attempt to reverse-engineer, exploit, or overload the Service
- Share account credentials with unauthorized users
8. Limitation of Liability
DocDraft is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use of generated documents, including but not limited to clinical errors, insurance denials, or legal consequences. The reviewing provider bears full responsibility.
9. Changes to Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
